1. Who we are
Bidline Pty Ltd (ACN 698 484 847, ABN pending). Bidline operates a verified off-market property marketplace for agents and pre-approved buyers. We are a marketplace facilitator. We are not a real estate agent, auctioneer, lawyer, financial adviser, or escrow provider.
2. Verification
Every account is reviewed and approved by Bidline team members. We may reject an application if we cannot verify your identity, licence, agency relationship, or pre-approval. We do not warrant that verified members will conduct themselves lawfully, only that they have passed our verification at the time of approval.
3. No money flows through Bidline
Bidline does not process payments, escrow, or settle property transactions. All money flows happen off-platform via the parties' nominated lawyers or conveyancers. We host the negotiation and audit log only.
4. Compliance with AU law
You must comply with NSW Property and Stock Agents Act 2002 (and the equivalent statute in your jurisdiction), Australian Consumer Law Schedule 2 ss18 and 30 (misleading conduct), Privacy Act 1988, and Spam Act 2003. Pre-approved buyers may not bid above their verified pre-approval amount.
5. Audit trail
We retain audit logs for as long as Australian agent record-keeping law requires. You consent to this retention.
6. Disputes
Bidline does not arbitrate disputes between users. We may produce the audit log to a party or to a regulator on lawful request.
7. Termination
We may suspend or terminate your account for breach, non-payment, regulatory complaint, or repeated low ratings. You may close your account at any time; subject to data-retention obligations.
8. Limitation of liability
To the maximum extent permitted by law, Bidline's liability for any claim arising out of your use of the platform is limited to the fees you have paid in the prior 12 months (or A$0 if you are on a free tier).
